ICLEI, founded in 1990 as the International Council for Local Environmental Initiatives, and known since 2003 asĀ Local Governments for Sustainability, counts nearly 600 U.S. cities as its members as of April 17, 2011.

Article I, Section 10 of the U.S. Constitution states, in part:

No State shall enter into any Treaty, Alliance, or Confederation;

If a State is prohibited from doing something, then so are its political subdivisions. Therefore, it is unconstitutional, and therefore unlawful, for any U.S. municipality to enter into any treaty, alliance or confederation.

The reason for this prohibition is that the States entered into a federal union, with the requirement that all treaties be ratified by a two-thirds majority of the U.S. Senate, which has equal representation among all 50 states. Any treaty or association by the States or their subdivisions will necessarily conflict with the federal union they have entered into.

ICLEI’s site states that it is “an international association of local governments as well as national and regional local government organizations who have made a commitment to sustainable development.

On their Membership FAQs page, they state, “Full Membership in ICLEI is offered to local governments and associations of local governments.

Associations of local governments include regional governments, showing from their own words that they recognize constitutional associations of local governments in association with each other as also being in association with ICLEI (unconstitutionally).
